Centre Notifies Establishment of Mediation Council of India: A New Step Towards Faster Dispute Resolution

Centre Notifies Establishment of Mediation Council of India: A New Step Towards Faster Dispute Resolution
The Central Government has officially established the Mediation Council of India under Section 31 of the Mediation Act, 2023, with its head office in Delhi.

Why in News

The Central Government issued Gazette Notification S.O. 4781(E) on 27 August 2026, formally establishing the Mediation Council of India (MCI). The Council will have its head office at Delhi.

This development is important because the Mediation Act, 2023 was designed to strengthen mediation in India, particularly institutional mediation, pre-litigation mediation, online mediation and community mediation. The establishment of the Council gives an institutional framework for carrying out several functions contemplated by the Act.

The attached study material also highlights the Council's responsibilities, including registration of mediators, setting professional and ethical standards, recognition of mediation institutions and service providers, training and capacity building, publication of information, and promotion of domestic and international mediation.

Legal Issue

The main legal issue is the establishment and statutory role of the Mediation Council of India under Section 31 of the Mediation Act, 2023.

Section 31 provides for the establishment of the Council by notification of the Central Government. It also provides that the Council will be a body corporate and that its head office shall be at Delhi or another place notified by the Central Government.

 Background

Imagine two businesses entering into a contract. A dispute later arises regarding payment. Traditionally, the parties may approach a court, beginning a process that can take considerable time and money.

Mediation offers another path. Instead of asking a judge to decide the dispute, a neutral mediator helps the parties communicate and attempt to reach a mutually acceptable settlement.

Recognising the importance of this process, Parliament enacted the Mediation Act, 2023. The Act seeks to promote and facilitate mediation, particularly institutional mediation, provide for enforcement of mediated settlement agreements, establish a framework for registration of mediators, encourage community mediation and make online mediation an acceptable and cost-effective process.

The next important step has now taken place.

On 27 August 2026, the Central Government issued Gazette Notification S.O. 4781(E), exercising its power under Section 31(1) of the Mediation Act, 2023. Through this notification, the Mediation Council of India was formally established, with its head office at Delhi.

The Council is not merely an administrative body. The Act assigns it important regulatory and developmental responsibilities. These include registering mediators, laying down professional and ethical standards, recognising mediation institutes and service providers, prescribing standards for their functioning, promoting education and training, and developing India as a centre for domestic and international mediation.

The Council can also call for information from mediation institutions and service providers, publish relevant information and research, maintain an electronic repository of mediated settlement agreements, and perform other functions assigned under the Act.

The Council therefore represents an important institutional step towards creating a more organised, professional and reliable mediation system in India.

 Landmark Cases

1. Salem Advocate Bar Association, T.N. v. Union of India, AIR 2005 SC 3353; (2005) 6 SCC 344

The Supreme Court dealt with the implementation of Section 89 of the CPC and recognised the importance of Alternative Dispute Resolution mechanisms, including mediation. The Court also supported the development of proper rules and procedures for effective mediation.

2. Afcons Infrastructure Ltd. v. Cherian Varkey Construction Co. (P) Ltd., (2010) 8 SCC 24

The Supreme Court explained the scope of Section 89 CPC and discussed when disputes may appropriately be referred to different ADR processes. The judgment became an important authority for understanding court-referred ADR and mediation.

3. Patil Automation (P) Ltd. v. Rakheja Engineers (P) Ltd., AIR 2022 SC 3848; (2022) 10 SCC 1

The Supreme Court held that pre-institution mediation under Section 12A of the Commercial Courts Act, 2015 is mandatory, subject to the statutory exception relating to suits contemplating urgent interim relief. The decision highlighted mediation as an important mechanism for reducing unnecessary litigation.

 Importance

For common citizens, the establishment of the Mediation Council can contribute to:

  1.  Better quality and professional standards for mediators.
  2.  More organised mediation institutions and service providers.
  3.  Greater awareness and accessibility of mediation.
  4.  Development of online and community mediation.
  5.  Faster and less adversarial resolution of suitable disputes.
  6.  Reduction of unnecessary burden on courts.

The larger objective is to make mediation a stronger part of India's dispute-resolution system rather than treating it merely as an optional alternative to litigation.

1. Salem Advocate Bar Association, T.N. v. Union of India, AIR 2005 SC 3353; (2005) 6 SCC 344

2. Afcons Infrastructure Ltd. v. Cherian Varkey Construction Co. (P) Ltd., (2010) 8 SCC 24

3. Patil Automation (P) Ltd. v. Rakheja Engineers (P) Ltd., AIR 2022 SC 3848; (2022) 10 SCC 1
